Agreement to Terms

By accessing or using Daily Automations services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services

Daily Automations provides workflow automation consulting, development, and monitoring services. We work with you to design, build, and maintain custom automations using tools like Make.com, Zapier, n8n, and custom code.

Specific scope, deliverables, timelines, and pricing are defined in a project Statement of Work (SOW) or retainer agreement. Services begin only after both parties have signed the applicable agreement.

Your Responsibilities

As a client, you are responsible for:

  • Providing accurate and complete information about your workflows and requirements
  • Granting authorized access to third-party tools and services as needed
  • Testing automations before they go live in production
  • Maintaining active subscriptions to required third-party services
  • Communicating changes to your systems that may affect automations
  • Providing timely feedback and approvals during development

Intellectual Property

Upon full payment, you own the custom automations, workflows, and documentation created specifically for your business. You retain all rights to automations running on your accounts.

We retain rights to reusable components, frameworks, and methodologies that are not custom to your business. We may use knowledge gained from our work to improve services for other clients, but will not share your proprietary information or trade secrets.

Payment Terms

Retainer clients are billed monthly with payment due within 30 days. Project-based work requires a 50% deposit before work begins, with the remaining balance due upon completion.

Late payments are subject to a 1.5% monthly fee. Services may be suspended for overdue accounts. We reserve the right to terminate services for non-payment.

Cancellations and Refunds

Retainer agreements require 30 days notice for cancellation. You may cancel at any time after the initial commitment period with proper notice. No refunds are provided for partial months.

Project deposits are non-refundable once work has commenced. If you cancel a project mid-development, you will be billed for work completed up to that point.

Client Accounts and Credentials

Automations run on your accounts. You maintain ownership and control of your data and credentials. We recommend using dedicated API keys and limiting access as appropriate.

You are responsible for securing your accounts and credentials. Notify us immediately if you suspect unauthorized access.

Limitation of Liability

Our services are provided "as is." We make no warranties, express or implied, regarding the performance, reliability, or suitability of automations for your specific needs.

We are not liable for damages arising from service interruptions, third-party platform changes, or automation failures. Our liability is limited to the fees paid for the specific services giving rise to the claim.

Third-Party Services

Our work depends on third-party platforms (Make.com, Zapier, n8n, etc.). We are not responsible for changes to these platforms that affect automations. We will notify you of significant changes and help adapt as needed.

You maintain separate agreements with these third parties. Their terms and service status affect your automations.

Monitoring and Support

Retainer plans include 24/7 monitoring and support. We monitor automations for failures and respond to issues. Response times are defined in your service agreement.

Support covers automations we have built. We do not provide support for third-party tools or automations created by others.

Confidentiality

We respect your confidentiality. We do not share your proprietary information, trade secrets, or sensitive business data with third parties except as necessary to provide services or as required by law.

We may use anonymized examples from our work for case studies or marketing purposes, but will not identify you without your explicit permission.

Termination

We reserve the right to terminate services for violations of these terms, non-payment, or other reasonable cause. We will provide notice and opportunity to cure when possible.

Upon termination, you retain all automations and documentation. We will provide a reasonable transition period and export your data upon request.

Governing Law

These terms are governed by the laws of the jurisdiction where Daily Automations is established. Any disputes will be resolved through good faith negotiation or, if necessary, binding arbitration.

Changes to Terms

We may update these terms from time to time. Significant changes will be communicated via email or posted notice. Continued use of services after changes constitutes acceptance.
